Software Licence Agreement

Last updated: 2 November 2026

This agreement governs the software supplied by Maximilian Freist, Feuln 15, 95367 Trebgast, Germany (“I”, “me”) through maxfreist.com. The purchase is made through Lemon Squeezy; this agreement sets out the rights granted by me as the software’s licensor.

1. Permitted use

Upon purchase, you receive a non-exclusive, worldwide, perpetual licence to use the purchased software:

  • by one natural person, or, for a company purchase, by one designated person at a time;
  • on any number of devices that person owns or controls;
  • for personal and commercial work

One licence may not be shared by several people at the same time. You retain your rights in work you create using the software.

2. Copies, distribution and third-party rights

You may make the copies needed for the permitted installations and backups. You may not distribute, rent, share, sublicense or incorporate the software into another distributed product without permission, except where mandatory law permits this.

Statutory rights to transfer a software copy, including rights arising from exhaustion, remain unaffected. You may not modify, decompile, disassemble or reverse engineer the software except as permitted by mandatory law, including §§ 69d and 69e UrhG.

Copyright and licence notices must be retained. Third-party components remain subject to their own licences; this agreement does not restrict rights granted under those licences.

3. Updates

Your licence includes all updates I release for the purchased product, including major versions, at no extra charge.

The product page lists the third-party software versions supported at the time of purchase. Later third-party releases may require a compatibility update. I do not promise new features or support for every future third-party release. You retain all statutory rights to updates, including security updates.

4. Live use

Back up your show file before installing or updating the software. Test the software and updates with your actual setup before a show.

These independent third-party tools add new workflows and functionality to your system. I cannot guarantee error-free integration or uninterrupted operation with every combination of hardware, software versions and settings.

Keep direct access to the lighting console and a manual fallback available. The software is not intended for safety-critical control. If an error or a console or software crash interrupts your show or other work, section 5 governs my liability for any resulting loss.

5. Liability

For ordinary negligence, I am liable only if I breach a duty that is essential to the performance of this agreement and on which you can reasonably rely. In that case, my liability is limited to losses typical of this type of agreement and foreseeable when it was made. These limits do not apply to intentional misconduct or gross negligence, death or personal injury, fraudulently concealed defects, claims under an express guarantee I have given, or mandatory product liability. Your statutory rights concerning defective software remain unaffected.

If the software is defective, you can exercise your statutory rights under the purchase contract directly with the seller, Lemon Squeezy (Sold through Link, LLC). Its contact details are in your order confirmation. For technical support or claims under my Software Licence Agreement, contact me at yourmixsucks42@gmail.com.

6. When the license ends

Your licence ends if you validly withdraw from the purchase or if the purchase is otherwise reversed in full. A price reduction, partial refund or chargeback does not by itself end the licence.

I may terminate the licence for a serious breach that makes it unreasonable to continue this agreement, such as distributing copies in breach of section 2.

When the licence ends, you must stop using the software under that licence.

7. Applicable law

German law applies, excluding the CISG. Consumers retain the protection of mandatory law applicable in their country of habitual residence. Statutory rules on jurisdiction remain unaffected.
